terms of service

1. who we are

yapcap (the discord bot, this website and related services) is operated by Dominik Scheidel, c/o Postflex #5812, Emsdettener Str. 10, 48268 Greven, Germany ( "we"). by adding yapcap to a server or using it, you agree to these terms and to discord's terms of service. if you add yapcap to a server, you also confirm you're allowed to do so for that server.

2. what yapcap does

yapcap counts activity in discord servers (messages, reactions, voice and more, as described in our privacy policy) and turns it into recaps, awards and stats cards. the core of yapcap is free. paid extras only add things on top; they never take anything free away.

3. fair use

please don't:

• use yapcap on servers that break discord's community guidelines
• use recaps or awards to harass, bully or expose anyone
• exploit bugs, overload the bot, or automate or scrape it
• try to access yapcap's backend or reverse-engineer it
• impersonate yapcap or its team

we may block servers or users that do, without notice where needed to protect the service or other people.

4. the yearly wrapped

the yearly wrapped is a one-time purchase for one discord server and one calendar year. it unlocks the full wrapped for that server (posted from dec 1, plus the final cut on jan 1), award cards and personal year cards for its members. a purchase in january counts for the year before. it is not a subscription and does not renew.

5. pro

pro is a subscription for one discord server. it unlocks quarterly recaps and custom ranges, and the further pro features we add over time. it renews each period until cancelled; you can cancel any time, and it stays active until the end of the period you paid for. when it ends, pro features stop applying, but nothing you configured is deleted. a server can only hold one active pro subscription.

6. buying

purchases are made by someone who can manage the server they're for (the buyer), and the contract is with the buyer. you can buy on this website (payment processed by stripe) or inside discord. purchases inside discord are sold, billed and refunded by discord under its terms. prices are shown before you pay and include vat where it applies. everything is delivered automatically after payment. cancellation, refunds and your right of withdrawal are explained on our refunds page.

7. availability and changes

we work hard to keep yapcap running, but we can't promise it will always be available or error-free, for example when discord has an outage or changes its platform. we may add, change or remove features; we won't remove a paid feature during a period you've already paid for without offering a fair refund.

8. liability

we are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the german product liability act. for slight negligence we are only liable for breach of essential contractual obligations, limited to the damage typical and foreseeable for this kind of contract. otherwise our liability is excluded.

9. ending it

you can stop using yapcap any time by removing it from your server; its data is then deleted after 7 days, except records we must keep by law (see the privacy policy).

10. the rest

german law applies, excluding the un convention on contracts for the international sale of goods; if you're a consumer, the protective rules of the country you live in still apply. if one part of these terms is invalid, the rest stays in force. we may update these terms and will change the date above; for paid services, we'll tell you about important changes in advance.
